How Family Law Mediation Works in New Jersey

The process typically begins with both parties selecting a mutually acceptable mediator or having one appointed by the court. The mediator opens by explaining the ground rules, gathering background on the family’s situation, and identifying the specific issues to be resolved.

From there, sessions involve guided discussion aimed at reaching agreement on each outstanding matter. When the parties reach resolution, the mediator drafts a settlement document that both parties and their attorneys review before it’s submitted to court, where it can become a binding order.
