Filing for Divorce in New Jersey as a Military Family

New Jersey requires at least one spouse to have been a bona fide resident of the state for 12 consecutive months immediately before filing, under N.J.S.A. 2A:34-10. Military families have three paths to meet that threshold: the service member is stationed in New Jersey regardless of legal domicile, the non-military spouse resides in New Jersey, or the service member claims New Jersey as their legal home of record. Active-duty deployment can complicate timing. Under the Servicemembers Civil Relief Act (SCRA), a federal law designed to protect service members from civil proceedings during active duty, a deployed service member can request a stay of divorce proceedings for a minimum of 90 days when military duties prevent meaningful court participation. Knowing when to invoke that protection, and when doing so works against your timeline, is one of the first decisions a military divorce attorney must think through.

How New Jersey Courts Divide Military Retirement Pay

Federal law governs whether a state court can divide military retirement pay at all. The Uniformed Services Former Spouses’ Protection Act (USFSPA), codified at 10 U.S.C. Section 1408, authorizes state courts to treat disposable military retired pay as divisible marital property. New Jersey courts apply equitable distribution to this asset, meaning the division reflects the circumstances of the marriage rather than a strict 50/50 split.

To calculate the marital share of a pension, New Jersey courts typically use the coverture fraction method: the years of marriage that overlapped with military service, divided by total years of service, establishes what portion of the pension is subject to division. A separate but related rule, the 10/10 rule, determines how payments are made. When at least 10 years of marriage overlapped with 10 years of creditable service, the Defense Finance and Accounting Service (DFAS) can pay the former spouse directly. Marriages shorter than 10 overlapping years don’t eliminate a spouse’s entitlement to a share. They simply change the payment mechanism.

Support calculations in a military divorce go beyond base pay. A complete picture requires reviewing the service member’s Leave and Earnings Statement, which reflects Basic Allowance for Housing (BAH) and Basic Allowance for Subsistence (BAS). Both allowances can factor into income calculations for alimony and child support purposes under New Jersey law.
