Child Custody Relocation in Philadelphia
Protect Your Custody Rights Before a Philadelphia Relocation
A move that substantially limits another party’s ability to exercise custody can require formal notice, consent, or court approval under Pennsylvania child relocation law. William Kirby Law, Family Law Attorneys represents parents seeking to relocate and those opposing a move, with attention to its effect on the existing custody arrangement.
Relocation disputes often require action before the planned moving date. We help parents evaluate the current custody order, follow procedural requirements, negotiate new arrangements, and prepare for a contested hearing when agreement isn’t possible.
To discuss relocation plans or a notice you received, call (215) 515-9901 and request a confidential consultation. Same-day appointments are available.
What Qualifies As Child Custody Relocation?
Under Pennsylvania law, relocation means a change in a child’s residence that significantly impairs a nonrelocating party’s ability to exercise custodial rights. Distance alone doesn’t determine whether a move qualifies. What matters is the practical effect on parenting time and the other party’s access to the child.
A child can’t be relocated unless every person with custody rights consents or the court approves the move. Because relocation may alter where and how custody occurs, the planned move can also support a request for custody modification.
Pennsylvania Notice & Objection Deadlines
The relocating parent generally must send written relocation notice by certified mail, return receipt requested, no later than 60 days before the move. If providing 60 days’ notice wasn’t reasonably possible, it’s due within 10 days after the parent learns of the relocation.
The notice must include available information about:
- The new residence and its mailing address
- The people expected to live in the new household
- The new telephone number, if available
- The school district and proposed school
- The relocation date and reasons for the move
- A proposed parenting schedule
The notice must also include a counter-affidavit that allows the other party to object. A nonrelocating party generally has 30 days after receiving it to file an objection and serve it on the other party by certified mail, return receipt requested. A party who doesn’t object on time is presumed to have consented to the relocation, so prompt review is important.

Representation Through Negotiation, Hearings & Enforcement
We handle child custody matters from early negotiation through contested hearings at Philadelphia Family Court. Our representation can include reviewing a relocation notice, preparing an objection or counter-affidavit, developing proposed custody terms, presenting evidence, and addressing custody modification connected to the move.
Relocation issues can continue after an order is entered. We handle custody enforcement actions when compliance becomes a concern. We also handle relocation-driven emergency custody petitions through the Court of Common Pleas, Family Division, when circumstances require immediate judicial attention.
